Scott Brooksby is an experienced trial lawyer who has defended businesses, manufacturers, and organizations in many personal injury and other tort cases, as well as wrongful death actions. He has defended and counseled product manufacturers and distributors in a variety of industries including toys and recreational products, paints and solvents, power tools, heavy equipment and machinery, retail, food, consumer products, and automobiles. He is the former co-chair of a large West Coast law firm's product liability practice group.
Scott also has over a decade of experience with the representation of religious organizations in the defense of tort claims based on negligence and vicarious liability theories.
Scott has tried numerous personal injury product liability and negligence civil trials in Oregon state and federal courts. He has also resolved hundreds of cases through arbitrations and mediation. He has successfully argued many motions which resulted in case dismissals or other favorable results. He has advised many of his clients on the development of strategies to avoid claims, litigation, and unwanted governmental action.

Personal Injury
Represented a manufacturer and distributor in a high-profile case involving a child who ingested a piece of toy jewelry made of lead. The child allegedly sustained brain damage. Scott also advised the client on media management and shaping the case for successful resolution through pretrial motions. The case was resolved through a settlement.
Represented a major national retail chain in a premises liability action where the plaintiff was severely injured after falling on the premises. After a 3-day jury trial in U.S. District Court, the jury returned a verdict in favor of the defendant retailer.
Defended a major manufacturer of inflatable aquatic recreational products in a 6-day jury trial involving alleged product defects, as well as a claim for millions of dollars in damages. The case was favorably resolved during jury deliberations.
Represented a beverage distributor and its truck driver employee in a 3-day jury trial where the plaintiff suffered serious spinal injuries. In an admitted liability trial, the jury awarded the plaintiff a fraction of the requested damages.
Represented a national utility company in a catastrophic accident case in which three men were killed and another seriously injured. The case was resolved during an early mediation.
Products Liability
Represented a worldwide manufacturer of high-voltage utility equipment in an electrocution case based on product liability and negligence theories. The trial court granted summary judgment for the manufacturer based on the statute of ultimate repose.
Represented a worldwide beverage manufacturer in a case alleging food contamination. The case was resolved before trial while legal motions were pending.
Represented one of the world's leading pharmaceutical and orthopaedic implant manufacturers in several cases involving allegations of millions of dollars in damages due to allegedly defectively designed or manufactured medical devices. The cases were resolved through early alternative dispute resolution.
Risk Management Consulting
Served as outside national coordinating counsel to a Northwest-based manufacturer of heating equipment on a number of litigation matters involving product liability as well as several employment, insurance, business, trademark, contract, and risk management best practices.
Served as an advisor to the local branch of a worldwide religious organization on issues related to internal employment practices and best practices for investigating potential tort claims, working with governmental agencies, and mandatory child abuse reporting obligations.
